DISCLAIMER
I-MED Pharma Inc. shall not be liable for any injury or damage suffered by a patient as a result of implantation technique, prescription, selection and use of any I-MED Pharma Inc. product by the physician. The physician shall exercise sole judgment and bear sole responsibility for selecting and performing any method or technique of surgery and for prescribing use of a medical device for any particular patient or patient's condition.
TERMS
Minimum order $100.00. For Canadian and USA clients who place orders with a net value of $1,000 or more, orders will be shipped prepaid by seller's choice of carrier (ground service). More expensive transportation, if requested, will be charged to the consignee's account, less the cost of the routine transportation. Product presentations must be ordered in minimum shipping quantities listed, or in multiples thereof.
LIABILITY
I-MED Pharma Inc. cannot be held liable for any failure to fulfill any contract or supply any materials due to labour disputes, fires, explosions, floods, riots, lockouts, injunctions, interruptions of transportation, unavoidable accidents, inability to obtain supplies at reasonable prices or other causes beyond our control.

CLAIMS
If packages arrive in a damaged condition or are lost, please insist upon the transportation company's agent noting the damage or loss upon your bill. Goods are shipped at consignee's risk. I-MED Pharma Inc. will, however, assist in the process of claims against carrier provided I-MED Pharma Inc. is notified within 7 days of receiving the shipment.
PAYMENT BY CREDIT CARD
Payment via credit card, VISA or MasterCard, may ONLY be made at time the order is placed. Credit cards will not be accepted for payment of invoices showing terms and transmitted to the client either by mail, e-mail of fax.
RETURNED GOODS POLICY
It is the company's desire to maintain a just policy regarding merchandise which the customer, for various reasons, may wish to return for credit or exchange. However, it is necessary to define certain reasonable restrictions.
PRE-AUTHORIZATION
Prior authorization for the return of merchandise must be received from I-MED Pharma Inc. before goods may be returned to the company for credit or replacement. Indication of authorization will be in the form of an assigned authorization number or code which must be indicated on the itemized list of products being returned to the company.
RETURNABLE MERCHANDISE
The following types of merchandise will be accepted for credit or exchange:
a) An error made by I-MED Pharma Inc. employee if reported within 48 hours of receipt.
b) Product having a manufacturing defect.
c) Product that is recalled.
d) Consignment IOLs that have expired within 30 days of expiration date. Merchandise will be accepted for credit or exchange under the following conditions:
Merchandise will be accepted for credit or exchange under the following conditions:
1) The return has been pre-authorized as indicated by an I-MED issued authorization number or code and is accompanied by the company's Authorization for Return Merchandise (ARM) form and an itemized list of goods.
2) All approved returns of goods are to be shipped prepaid. In the event that the goods are returned collect, this amount will be deducted from the associated credit transaction.
3) Any return required as a result of one of the first three conditions mentioned above may be returned to the company by a carrier designated by I-MED Pharma Inc.
4) All returned goods are to be in the ORIGINAL UNOPENED trade containers.
5) All return shipments must bear the name and address of the sender.
6) A restocking charge of 25% will apply.
Credit may be in the form of replacement merchandise. Returns will be credited at current prices or original purchase price, whichever is lower.
NON-RETURNABLE MERCHANDISE
The following types of merchandise will not be accepted back for credit or exchange:
a) Goods which have been opened, broken or partially used or merchandise which has been tampered with in any way, including packages damaged by fire, water, or an act of God.
b) Products returned by other than the original purchaser.
c) Consignment IOLs returned more than 30 days after expiration.
d) Products supplied on specific order to customer's specification and/or when the invoice is marked “non-returnable”.
e) Products which have been damaged due to improper storage conditions.
f) Discontinued goods returned more than 30 days after the mailing of the notice of discontinuation.
g) Products requiring refrigeration will not be accepted for return.
h) No merchandise may be returned after 30 days.
i) Product designated to be used “FIFO” and which was sold to client prior to the latest sale of the same product.

RENONCIATION
I-MED Pharma Inc. ne sera pas tenu responsable des blessures ou dommages subis par le patient et résultant d'une technique d'implantation d'une prescription, sélection ou utilisation d'une lentille intraoculaire par le médecin. Le médecin doit utiliser son seul jugement et porter l'entière responsabilité de la sélection de la technique d'implantation utilisée d'un appareil médical selon l'état de santé du patient.
TERMES
Commande minimale 100$. Toute commande d'une valeur nette de 1,000$ et plus sera expédiée port payé selon le mode d'expédition déterminé par le vendeur (transport terrestre). Si le destinataire exige un moyen de transport plus coûteux, il aura à en assumer les frais, moins ceux du transport régulier. On devra commander les formats des différents produits selon le minimum des quantités indiqués ou selon leurs multiples.
RESPONSABILITÉ
I-MED Pharma Inc. ne peut être tenue responsable si elle fait défaut à remplir un contrat ou à fournir du matériel suite à des conflits de travail, des incendies, des explosions, des inondations, des émeutes, des lock-out, des injonctions de interruptions de transport, des accidents inévitables l'impossibilité d'obtenir des matières premières à des prix raisonnables ou d'autres causes indépendantes de sa volonté.

Information ou description des produits sont sujets à changement sans préavis.
RÉCLAMATIONS
Si les emballages sont endommagés au moment de la livraison ou encore, si certaines marchandises ont été perdues, veuillez insister auprès du représentant du transporteur pour qu'il en soit fait mention sur votre facture. Les marchandises sont livrées au risque du consignataire. Toutefois, la Compagnie IMED Pharma Inc. prendra part au procédures de réclamation auprès du transporteur pour autant qu'elle sera avisée dans les 7 jours suivant la réception des marchandises.
POLITIQUES DE RETOUR DE MARCHANDISES
Il est dans l'intention de la Compagnie de maintenir une politique équitable envers le client qui pour quelque raison que ce soit, désire retourner de la marchandise au fins de crédit ou d'échange. Il est toutefois nécessaire pour cela de définir certaines restrictions raisonnables.
AUTORISATION
Avant de renvoyer de la marchandise à I-MED Pharma Inc. pour obtenir un crédit ou un échange, le client doit recevoir l'autorisation de la Compagnie.
Ce dernier assigne au client un numéro ou un code d'autorisation qui devra apparaître sur la liste détaillée des produits retournés qu'il joindra au colis.
MARCHANDISE RETOURNABLE
La marchandise suivante est acceptée aux fins de crédit ou d'échange:
a) Marchandise retournée à cause d'une erreur commise par un employé de I-MED Pharma Inc.
b) Produit présentant un défaut de fabrication.
c) Produit rappelé.
d) Produit périmé dont la date d'expiration remonte à soixante jours ou moins.
Le crédit ou l'échange sera accordé qu'aux conditions suivantes:
e) Le retour doit avoir été autorisé, comme l'indique le numéro ou le code assigné par I-MED
f) Pour tous les retours approuvés de marchandise périmée, les frais de transport sont payables par l'expéditeur. En revanche, si le transport d'une telle marchandise est déboursé par le destinataire, les frais seront déduits de l'opération de crédit correspondante.
g) Pour les trois premiers types de marchandise énumérés plus haut, le client renvoie la marchandise à la Compagnie par un transporteur choisi par I-MED Pharma Inc. Dans ce cas, les frais de transport sont assumés par la Compagnie.
h) Tous les produits doivent être retournés dans leur contenant orignal (lequel ne doit pas avoir été ouvert).
i) Le nom et adresse de l'expéditeur doivent être indiqués sur chaque colis retourné.
j) Un frais de 25% sera charger
Le crédit peut être consenti sous la forme de marchandise de remplacement. Les retours sont crédités au prix courant ou au prix d'achat original (le plus bas ayant préséance).
MARCHANDISE NON RETOURNABLE
Aucun crédit ni échange ne peut être accordé pour les marchandises suivantes:
a) Produits dont le contenant a été ouvert, brisé ou partiellement vidé, ou encore marchandise altérée de quelque manière que ce soit, y compris les colis endommagés par le feu, l'eau ou tout désastre naturel.
b) Produits retournés par une personne autre que l'acheteur original.
c) Lentilles intraoculaires en consignation périmés et retournés plus de 30 jours après la date d'expiration.
d) Marchandise faisant partie d'une commande particulière, préparée selon les spécifications du client.
e) Produits altérés en raison d'un entreposage inadéquat.
f) Produits (dont la fabrication a été abandonnée) retournés plus de 30 jours après l'envoi de l'avis d'arrêt de production.
g) Produits exigeant la réfrigération.
h) Produits ne peuvent être retournées après 30 jours.
Il est interdit aux représentants de I-MED Pharma Inc. de modifier les conditions relatives au retour de marchandises.
